The Constitutional Right to Failure

I propose a new constitutional amendment:
"The right to fail and to suffer the consequences of failure shall not be abridged, nor shall the federal government enact legislation that provides relief for such an individual, group or organizations failure, whether governmental or non-governmental."

Well, remember that this is an amendment to allow for failure, not to allow negligent harm. If I have a botched surgery through negligence, I wasn't the one that failed. But there should be a second part that does allow for the protection from lawsuits provided a proper assumption of risk.
